The ROASTINGIFT Service

ROASTINGIFT creates personalized comedy and roast content based primarily on information and creative preferences supplied by the purchaser. Depending on the product purchased, the final product may include personalized audio, written content, a digital gift experience, or other personalized digital materials described at the time of purchase. ROASTINGIFT may use a combination of human creative work, software tools, automated technologies, and artificial-intelligence-assisted technologies during production.

Eligibility and Purchases

You must have the legal capacity to enter into a binding agreement in your jurisdiction to place an order. You agree to provide current, accurate, and complete information when placing an order and to use a payment method you are authorized to use. We may refuse, suspend, or cancel an order where reasonably necessary because of fraud, payment problems, legal requirements, abuse, prohibited content, technical limitations, or violations of these Terms.

Customer Submissions

You are responsible for the names, stories, facts, instructions, preferences, photographs or other materials, if applicable, and other information you submit to ROASTINGIFT. You represent that you have the rights and authority reasonably necessary to provide that material and request its use in creating the personalized product.

You must not knowingly submit content that: is unlawful; constitutes a genuine threat or unlawful harassment; unlawfully infringes copyright, trademark, privacy, publicity, or other rights; contains information you are prohibited from disclosing; is intended to facilitate fraud, abuse, exploitation, or other unlawful conduct. Please do not submit highly sensitive or confidential information that is unnecessary for the personalized roast.

Information About the Recipient and Other People

ROASTINGIFT allows purchasers to provide information about people other than themselves because that information is necessary to personalize the gift. You are responsible for deciding what information is appropriate to provide. By submitting information about another person, you represent that your submission and requested use of that information are lawful and do not violate applicable rights or obligations.

Comedy, Roast Content and Creative Interpretation

ROASTINGIFT is an entertainment service. A roast may intentionally contain teasing, sarcasm, exaggeration, parody, comedic interpretation, or intentionally provocative humor consistent with the information, preferences, and roast intensity selected by the customer. We aim to respect information and boundaries submitted with the order, but joke selection, wording, structure, pacing, performance, delivery, and other creative choices are inherently subjective. You understand that different people may react differently to comedy and personalized roast content.

Accuracy of Customer Information

Please review the information you submit before completing your order. ROASTINGIFT relies on that information in creating the personalized product. We are not responsible for inaccuracies resulting from materially incorrect, incomplete, misspelled, misleading, or contradictory information supplied by the customer. Where reasonably possible, corrections may be handled under our revision policy.

Orders and Payment

Checkout and payment may be processed through SamCart, Shopify, and applicable payment processors or other payment providers. Prices, available options, applicable taxes, and charges are displayed during the purchase process. Your order is not considered accepted for production merely because a checkout attempt was initiated. Payment must be successfully completed and the order accepted by our systems.

Production and Delivery

The applicable production or delivery timeframe is displayed with the product or during purchase. ROASTINGIFT may offer different service levels, including Standard and expedited or Ultra Fast production. We make reasonable efforts to meet the timeframe associated with the purchased service level.

Unless expressly stated as guaranteed, quoted completion times are service targets and may occasionally be affected by circumstances outside our reasonable control, technical failures, payment issues, customer-requested changes, or other unusual events. If a delay materially affects a paid expedited service, the remedies described in our Refund, Cancellation & Revision Policy apply.

Revisions

Unless a different allowance is clearly stated when you purchase, eligible personalized roast orders include up to two complimentary revision rounds. A revision is intended to adjust or correct the existing personalized product based substantially on the information, recipient, and concept contained in the original order.

Reasonable revisions may include changes to wording, emphasis, tone, delivery, joke treatment, or treatment of information that was included in the original request. A revision does not normally include: changing to a different recipient; replacing most or all of the original questionnaire information; requesting an entirely new creative concept; adding substantial new stories or instructions not included in the original order; converting the order into a different product. A request outside the reasonable scope of a revision may require an additional purchase or new order.

Personal Use and Gift Sharing

Unless otherwise expressly stated, personalized ROASTINGIFT content is licensed for personal, non-commercial use. You may listen to, enjoy, and share the delivered gift with the intended recipient, friends, family, or other people for ordinary personal purposes. Private gift links may be accessible to anyone who obtains the link. You are responsible for deciding who receives the link.

You may not resell, commercially license, falsely claim authorship of, or commercially exploit ROASTINGIFT's underlying platform, templates, software, branding, or proprietary production materials without our permission.

Intellectual Property and License to Customer Materials

You retain whatever rights you already hold in materials you submit. By submitting content to ROASTINGIFT, you grant Gifts Worth Buying LLC a non-exclusive, worldwide, limited license to host, copy, process, reproduce, adapt, transmit, and otherwise use that content as reasonably necessary to: create and produce your personalized order; provide revisions; deliver and host the gift; provide customer support; operate and secure the service.

This license does not give ROASTINGIFT the right to publicly use your private stories or personalized roast as marketing content without additional permission. ROASTINGIFT retains all rights in its software, website, branding, designs, workflows, templates, systems, and other proprietary materials.

Refunds and Cancellations

Refunds, cancellations, service problems, and revision eligibility are governed by our Refund, Cancellation & Revision Policy, which forms part of these Terms. Because our products are individually created for each customer, cancellation rights may be affected once personalized production begins. Nothing in these Terms or our Refund Policy limits mandatory consumer rights that cannot legally be waived.

International Customers and Consumer Rights

ROASTINGIFT is operated from the United States and may be available to customers in other countries. If you are a consumer, you may have mandatory rights under the laws of your country or place of residence. Nothing in these Terms is intended to remove or restrict consumer rights that cannot legally be excluded or waived. Where applicable law gives you cancellation, withdrawal, conformity, refund, privacy, or other rights that conflict with these Terms, the applicable mandatory law controls to the extent required.

Prohibited Use

You may not use ROASTINGIFT: for unlawful purposes; to make genuine threats; to facilitate unlawful harassment, stalking, exploitation, discrimination, fraud, or other unlawful conduct; to violate another person's intellectual-property, privacy, publicity, or other legal rights; to interfere with the security or operation of the service; to attempt unauthorized access to accounts, systems, gift pages, administrative areas, or other restricted resources. We may refuse or cancel requests that we reasonably believe violate these rules.

Third-Party Services

ROASTINGIFT relies on third-party services for portions of its operation, including ecommerce, checkout, payment processing, infrastructure, email, security, and content-production technologies. These services may include Shopify, SamCart, Resend, Cloudflare, payment processors, and other providers used from time to time. Some functionality may therefore be subject to the availability and applicable terms of those providers. Third-party checkout and payment providers may collect and process information directly from you in connection with a transaction. Their handling of information and their services may also be subject to their own terms and privacy policies.

Availability and Changes to the Service

We may modify, improve, replace, suspend, or discontinue features of ROASTINGIFT. For paid orders already accepted, we will make reasonable efforts to provide the purchased service or an appropriate remedy where we cannot do so.

Disclaimer

ROASTINGIFT provides personalized comedy and entertainment content. To the fullest extent permitted by applicable law, we do not guarantee that every purchaser or recipient will subjectively enjoy every joke, creative choice, delivery style, or comedic interpretation. The service is not professional legal, medical, financial, psychological, or other professional advice. Nothing in this section limits warranties, guarantees, or consumer remedies that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, Gifts Worth Buying LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the service. To the maximum extent permitted by applicable law, our aggregate liability for a claim relating to a particular paid order will not exceed the amount paid to ROASTINGIFT for that order. These limitations do not apply where liability cannot legally be limited or excluded.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Gifts Worth Buying LLC from third-party claims arising directly from material you knowingly submitted without the rights or authority necessary to use it, or from your unlawful misuse of the service. This provision does not limit rights or protections available to consumers under mandatory law.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. If you are a consumer, this choice of law does not deprive you of mandatory protections available under the laws of your country or place of residence.

Changes to These Terms

We may update these Terms from time to time. The version published when your order is placed generally governs that order, except where a change is required by applicable law or expressly agreed with you. The current version will be posted on this page with its “Last updated” date.
